1. Daleswan Pty Ltd ACN 105 650 075 (“Promoter”) will match the initial land deposit paid by purchasers of approved lots (set out below) up to the maximum value of $5,000 “Matched Amount” commencing 9am Monday 7th May 2018 and closing 5pm 30th June 2018.  The Promoter may extend the Promotion Period at its sole discretion (Extended Promotion Period).

2. The Promoter is wanting to encourage further quality housing construction in its Estate, and the approval of the house plans in accordance with the Building Covenants is a key part of that process.

3. The Promoter may select, remove or add approved lots eligible for the promotion at its sole discretion. Eligible lots will be confirmed by the Promoter’s Agent.

5. The Promoter will pay the Matched Amount to the purchaser in the form of a pre-paid Visa debit card in accordance with the terms of the Buyer’s Incentive Deed (attached).

6. Participants must execute and deliver a contract of sale for a Selected Lot in the vendor’s standard form of contract and the Buyer’s Incentive Deed during the Promotion Period (Contract Documents).

Qualification for Participation

7. The Participant must purchase the Selected Lot through the Promoter’s Agent, in order for the referrer to be eligible for the Matched Amount.

8. A referred person must not be an existing or previous purchaser from the Promoter.


9. The Promoter reserves the right to change the promotion by adding, deleting or amending these terms and conditions. If for any reason any aspect of this promotion is considered in the reasonable opinion of the Promoter to no longer be practical or desirable to run as planned for any reason, is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud, technical failures, legally binding directive to the Promoter to end any component of the promotion or any causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify, extend or suspend the promotion and the Promotional Period. In taking such action the Promoter may deem that the Promotional Period end on a date different to that provided for in these terms and conditions, including a date that has already occurred.

10. The Promoter reserves the right, in its sole discretion, to disqualify entry from any person, and prohibit that person's further participation in the promotion, who in the reasonable opinion of the Promoter tampers with, or benefits from any tampering with, the process or the operation of the promotion, acts in violation of these terms and conditions, acts in a disruptive manner or engages in unlawful or other improper conduct. The Promoter’s rights to recover damages or other compensation from such an offender are reserved.

11. The Promoter accepts no responsibility for any tax implications that may arise from the matched amount to be refunded. Independent financial advice should be sought. Where the operation of the promotion results in, for GST purposes, supplies being made for non-monetary consideration, referrers agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.

12. The Promoter reserves the right to withdraw any Applicable Lot from the Promotion during the Promotion Period unless the Participant has not delivered the signed Contract Documents.

13. It will be the responsibility of the Participant to contact the Promoter’s Agent to claim the Matched Amount.

14. By entering into the Promotion and delivering the executed Contract Documents to the Promoter, that Participant is deemed to have accepted these terms and conditions.

15. Participants must pay the purchase price under a Contract in full and must not seek to set off the Matched Amount against the purchase price under a Contract. The Matched Amount payable will only be paid in accordance with the Buyer’s Incentive Deed.
